Terms & Conditions

These are the terms and conditions which you must agree to in order to become a member of 2 of a Kind.  Your registration as a member indicates your acceptance of the current terms and conditions without modification.  If you do not agree to these terms and conditions, please do not register as a member or use this Web Site. 

These terms and conditions will remain in full force and effect as long as you are a member of 2 of a Kind.  You may terminate your membership at any time, for any reason, by using the available functionality or emailing the administrator.  

The terms of this agreement are subject to change by 2 of a Kind at any time.  They apply to use of the Web Site, as well as to any correspondence between yourself and 2 of a Kind.

1. To qualify as a 2 of a Kind member:
   1. You must be 18 years or over;
   2. You must be an individual;
   3. You must be Jewish, either by birth or conversion;
   4. You must be a resident of (or currently visiting) Australia or New Zealand;
   5. You must not be currently married (unless you have legally separated from your spouse). 
2. Conditions relating to your membership:It is a condition of membership of 2 of a kind that you;
   1. Keep us updated with your current e-mail address at all times;
   2. Maintain the confidentiality of your user name and password; Accept personal responsibility for all activities that occur under your 2 of a Kind profile name and password.
   3. Agree to immediately notify the administrators of 2 of a Kind of any unauthorised use of your profile name or password or any other breach of security, and ensure that you exit from your account at the end of each session.
   4. Be honest in all your dealings and communication with 2 of a Kind, and also with other members. This includes (but is not limited to) providing an accurate account of yourself on your membership profile, and – if providing a photograph – providing a recent, valid photograph of yourself.  You must not impersonate anyone else.
   5. Only use this Web Site for personal (non-commercial) use.  You must not solicit money from other members, collect names or e-mail addresses, or send unsolicited or mass e-mails; and
   6. Do not harass or in any way harm other members;
   7. Only have one membership and profile.

If you are in breach of any of these obligations, 2 of a kind retains the right  to terminate your membership.

3. Conditions relating to material that you post to the 2 of a Kind website and chat rooms:
   1. Any material that you post to the 2 of a Kind website or chat rooms will be considered non-confidential and non-proprietary. We retain all rights in relation to such material, including the right to copy, disclose, distribute, and use such material for any purpose as set out in this document.
   2. You are personally responsible for the material that you post on the 2 of a Kind Web Site and chat rooms. You agree that the material is accurate, not in breach of these Terms and Conditions, and not harmful to any person in any way.
   3. You must not post, distribute or reproduce intellectual property, including copyrighted material and trademarks, without obtaining the prior consent of the property owner.
   4. You must not include in your member profile or photos, any telephone numbers, street addresses, last names, URLs or email addresses.
   5. You must not transmit any chain letters, mass mail or junk email to other members.
   6. You must not post material (including photos) to the 2 of a Kind Web Site or chat rooms which:

• could be considered offensive;
• is abusive, threatening, obscene or defamatory promotes racism, hatred, harassment, or physical harm of any kind;
• promotes, or provides information about, illegal activities or conduct;
• belongs to someone other than yourself or impersonates someone else;
• exploits people under the age of 18;
• solicits passwords from other members;
• solicits money from other members;
• infringes the rights of 3^rd parties;
• is sexually explicit or contains sexual references; or pertains to group sexual activity or soliciting contact for the purpose of extra marital encounters or affairs.

4. Conditions relating to members and non-members:
   1. You must not frame or link to the 2 of a Kind Web Site without prior authorization.
   2. 2 of a Kind owns and retains all proprietary rights in the 2 of a Kind Web Site and any material posted on the 2 of a Kind Web Site and chat rooms. Our materials may not be reproduced, copied, edited, published, transmitted or uploaded in any way without our written permission.

5.    Disclaimers.
To the extent permitted by law, 2 of a Kind provides you with this 2 website on the basis that it excludes all representations, warranties, conditions and other terms.

6. When and how your 2 of a Kind membership may be terminated:
   1. Member-activated termination: You may terminate your membership at any time by using the available Web Site functionality.
   2. Automatic termination: If you have not logged on for 4 months, your 2 of a Kind membership will automatically be terminated.  You will receive e-mail notification 1 month prior to this, reminding you to log in to the 2 of a Kind Web Site. If you log in before the 4 months is up, your termination will be postponed for another 4 months (and so on, in perpetuity). 
   3.  2 of a Kind termination: We reserve the right to reject and/or terminate your membership at any time, for any reason, without prior warning. 

Note: If your 2 of a Kind membership is terminated, your details will continue to be stored on our database, to enable you to re-register at a later stage if desired or permitted, in the event that you have breached these terms & conditions.  Your details will only be deleted from our database upon written request.

7. 2 of a Kind rights & responsibilities.
   By accepting these terms & conditions, you acknowledge and agree that: 
   1. 2 of a Kind does not guarantee you results, and is not obligated to broker a relationship for you;
   2. 2 of a Kind reserves its rights in relation to all matters, including (but not limited to) rejecting or terminating your membership for any reason at any time, investigating incidents, modifying your profile and deleting prohibited or inappropriate content;
   3. While 2 of a Kind endeavours to ensure that the website  is normally available 24 hours a day, we do not guarantee that it will be uninterrupted or error free. Access to the 2 of a Kind Web Site may be suspended temporarily and without notice in the case of system failure, maintenance or repair or other reasons; and

8.    Limitation on Liability.

a.       Subject to any liabilities that may not be limited by law, 2 of a Kind, and any related entity, will not be liable or responsible to you or any third person for any amount or kind of loss or damage that may result (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption of any type, and whether in tort (including without limitation negligence), contract or otherwise) in connection with the 2 of a Kind website, or any 2 of a Kind events developed, staged, managed or outsourced by 2 of a Kind in any way or in connection with the use, inability to use or the results of use of this 2 of a Kind website. Subject to the foregoing, 2 of a Kind’s liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to 2 of a Kind for the Service during the term of membership.

b.       You are personally responsible for your interaction with other 2 of a Kind Members. 2 of a Kind reserves the right, but has no obligation, to monitor disputes between you and other Members.

c.       You agree that the any dispute will be governed by the laws of New South Wales.

d.       If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.

How we handle your personal information

Personal information is generally information or an opinion relating to an individual which can be used to identify that individual.

The personal information that 2 of a kind collects will generally including name and contact details, a photo, a description of you and other information helpful in determining matches. Your viewable profile does not include any information by which you can be identified except your username which you choose upon resignation. Once registered it is our choice what information you share with others.

2 of a kind collects your personal information in order to provide you with our services. We may also use it to provide you with information about related products or services that we think you may be interested in.

We may disclose your contact details to Network unless you provide us with a written request to do so.

We may use your personal information to third party suppliers who assist us in providing our services. This includes providers of Jewish singles events in Australia and New Zealand.

Whilst we endeavor to engage suppliers who comply with the privacy act – we don’t take responsibility for their actions. We don’t disclose your information to other organizations except as may be refused by law.

Our website may contain links to third party websites. We don’t operate these websites and therefore not responsible for the collection or handling of this information by the operators of these websites.
